The petitioner seeks bail in connection with Tiyar P.S. Case No. 59 of 2021 dated 02.09.2021 instituted for the offences under Sections 363/366(A)/34 of the Indian Penal Code.

Though the petitioner has been named in the F.I.R. but only on suspicion. He is alleged to have taken away the minor daughter of the Informant for the purposes of marriage.

The victim girl was recovered in a short while

Patna High Court CR. MISC. No.48926 of 2022(2) dt.22-12-2022 2/2 who has given a statement under Section 164 of the Cr.P.C. stating that she had gone along with one Neeraj to different places including Delhi from where she had returned to her parents' house.

In her statement under Section 164 Cr.P.C., she has not referred to the petitioner in any capacity and has also not stated that she was subjected to any sexual intercourse or pressure for marrying anybody. The petitioner is in custody since 04.09.2021. Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class in connection with Tiyar P.S. Case No. 59 of 2021.
