JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that out of seven proposed prosecution witnesses, only three prosecution witnesses have been examined. The trial court has sought for four months more time to conclude the trial of the petitioner.
Taking note of the report of the learned Sessions Judge, Bhagalpur, the prayer for bail of the petitioner in connection with Session trail no. 322 of 2015, arising out of Mojahidpur( Bhabarganj) P.S.Case No. 73 of 2013, pending in the court of 7th Additional Sessions Judge, Bhagalpur is again rejected.
However, if the trial of the petitioner is not concluded
Patna High Court Cr.Misc. No.14587 of 2016 (3) dt.03-08-2016 2/2 within the period fixed by the learned Sessions Judge, Bhagalpur, in his report dated 25.05.2016, the learned Sessions Judge, Bhagalpur shall release the petitioner on bail fixing the amount of bail bonds on his own satisfaction.
