JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 363 and 366 of the Indian Penal Code. Petitioner is not named either in the first information report or the statement of victim recorded under Section 164 of the Cr.P.C., but he has been dragged in this case on the ground that the mobile phone which was used by the victim after the occurrence stood his name and after recording the statement of victim under Section 164 of the Cr.P.C., victim appeared before the court and stated that she had made her statement under coercion.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named

Patna High Court Cr.Misc. No.15016 of 2016 (2) dt.11-04-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhishek Kunal,1st Class Judicial Magistrate, Gopalganj in connection with Fulwaria P.S.
