JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-06-2021 Heard Mr. Ravindra Kumar, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Vijaypur PS Case No. 202/2019 registered for the offence punishable under Sections 302/34 of the IPC.
The allegation, as per First Information Report, is that petitioner along with four other accused persons took away husband of the informant to an unknown destination and when husband of the informant did not return, she started looking for him and subsequently, his dead body was found hanging from a tree.
Learned counsel for the petitioner submits that the

No.4053 of 2021(3) dt.17-06-2021 2/3 petitioner has falsely been implicated in this case on the basis of suspicion only along with other co-accused persons and during course of investigation, it has come to light that the son of the informant namely, Ajay Ram was having love affairs with the daughter of co-accused, namely, Triveni Gond. Learned counsel next submits that other co-accused persons namely, Suresh Yadav and Heera Yadav @ Heeralal Yadav vide Cr. Misc. No. 31881/2020, Triveni Gond and Komal Gond @ Kamal Gond vide Cr. Misc. No. 38200/2020 have been granted bail by the co-ordinate Benches of this Court.
Learned counsel next submits that petitioner is in custody since 05.08.2020 and the charge-sheet has already been submitted in the matter.
Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that other co-accused persons have been released on bail by coordinate Benches of this Court, the petitioner is in custody since 05.08.2020 and the charge-sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, ANIL RAM be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.4053 of 2021(3) dt.17-06-2021 3/3 satisfaction of learned Additional Chief Judicial Magistrate-XV Gopalganj in connection with Vijaypur PS Case No. 202/2019.
