The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 346, 367, 370a, 372a, 373, 34, 120B of the Indian Penal Code and Sections 8/12 of the POCSO Act and Sections 75, 79 of J.J. Act and Sections 16, 17, 18 of the Bonded Labour Act. As per prosecution case, it is alleged that the petitioner who was owner of an orchestra programme was apprehended by the police officials and from his possession four girls were recovered.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal

As per Aadhar Card, the recovered girls are at the verge of majority and the petitioner has not pressurized and has not committed wrong with anyone rather the girls joined orchestra programme for earning their livelihood with their guardian permission. It is further submitted that the as per impugned order no girl whispered about any wrong doing against the petitioner. The petitioner is languishing in judicial custody since 04.02.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shikarpur P.S. Case No. 86 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court.
