JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code.

Altogether six persons including the petitioner are said to have assaulted the deceased by means of lathi and after that petitioner and co-accused, Raja Kewat are said to have assaulted the informant's wife causing head injury to her. Learned counsel for the petitioner submits that having similar allegation, co-accused, Manoj Kewat and Raja Kewat have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 03.03.2015 passed in Cr. Misc. No. 49436 of 2014 as well as Cr. Misc. No. 48957 of 2014

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 10.11.2015 and the investigation against him has already been completed, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Laukariya (Patkhauli) P.S. Case No. 23 of 2014.
