JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Bihpur P.S. Case No. 386 of 2013 registered for the offences punishable under sections 302 read with 34 of the Indian Penal Code and 27 of the Arms Act.

According to the allegations made in the First Information Report, the petitioner is alleged to have fired which did not hit any one.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 26.09.2014 passed in Cr.Misc. No. 34523 of 2014 with an observation that the petitioner would be at liberty to renew his prayer for bail after

Patna High Court Cr.Misc. No.21636 of 2015 (2) dt.13-05-2015 2/2 framing of charge.

It has been contended that the petitioner is in custody since 8th July, 2014 and the charges have already been framed by the court below against the petitioner on 17th April, 2015. Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Naugachia in connection with Sessions Trial No.111 of 2015 arising out of Bihpur (Bhawanipur) P.S.Case No. 386 of 2013.
