The petitioner seeks bail in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code.
The petitioner is alleged to be armed with dagger. Co-accused Tulli Rajabanshi is said to have assaulted with sword on the leg of the deceased which was severed and due to profuse bleeding, deceased Shyamdeo Yadav died. There is no specific allegation of assault against the petitioner. Similarly situated coaccused Sito Rajbanshi, Ram Swarup Rajbanshi and others have already been enlarged on bail. Even Tulsi Rajbanshi, who is alleged to be the assailant of the deceased has also been granted bail by order passed in Criminal Misc. No. 1548 of 2011.
Patna High Court Cr.Misc. No.21957 of 2015 (3) dt.08-09-2015 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawadah in connection with Akbarpur P.S. Case No. 260 of 2009.
