JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-07-2019 This is an application for grant of anticipatory bail in connection with Harsidhi P.S. Case No. 53 of 2019, disclosing offences under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Prosecution case as per the written report filed by the SHO of Police Station Harsidhi that police has received a secret information regarding manufacturing the illicit liquor and on that, police party raided the place of occurrence and arrested Yogendra Paswan and one other accused person. The other accused persons succeeding in fleeing away from there. The police party has recovered the country made liquor and articles for manufacturing the liquor. It is also alleged that arrested accused persons have named the petitioner.

Patna High Court CR. MISC. No.45172 of 2019(2) dt.23-07-2019 2/2 Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused persons, there is nothing against the petitioner and he has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides, considering the fact that except the confessional statement of the co-accused persons, there is nothing against this petitioner, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.D.J.-VII-Cum- Special Judge, Motihari, East Champaran, in connection with Harsidhi P.S. Case No. 53 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
