JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel representing the O. P. No. 2. The petitioner in this case is seeking anticipatory bail in connection with Complaint Case No. C-634 of 2010, Tr. No. 2336 of 2019 in which cognizance has been taken for the offences punishable under Section 498(A) of the Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act.

Perused the mediation report at flag 'M'.

Learned counsel for the parties jointly submit that now they have settled their dispute and in terms of the settlement all the cases are to be withdrawn.

In the aforesaid view of the matter, let the petitioner above named in the event of his arrest or surrender within a period of

No.46957 of 2019(4) dt.11-12-2019 2/2 four weeks from today be enlarged on bail on furnishing bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar at Motihari, East Champaran in connection with Complaint Case no. C -634 of 2010, Tr. No. 2336 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required; (ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (iii) a condition that the person shall not leave India without the previous permission of the Court. Let it be recorded that the present order has been passed in view of the settlement reached between the parties and in case of breach thereof it will be open for the aggrieved parties to take a suitable action.
