The petitioner seeks pre-arrest bail in connection with Belchhi P.S.Case No.44 of 2016 registered under Sections 147, 148, 149, 341, 323, 504, 353 and 427/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that co-accused Vinod Saw having identical allegation to that of the petitioner has already been granted pre-arrest bail by a Bench of this Court vide order dated 19.09.2007 passed in Cr.Misc. No.42961 of 2017.

Learned counsel for the State does not dispute the aforesaid contention of the learned counsel for the petitioner. Regard being had to the reasons assigned in the

Patna High Court Cr.Misc. No.60668 of 2017 (2) dt.21-12-2017 2/2 aforesaid order dated 19.09.2017 passed in Cr.Misc. No.42961 of 2017, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh in connection with Belchhi P.S.Case No.44 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
