In this case, the petitioner is seeking anticipatory bail in connection with Kursela P.S. Case No. 04 of 2019, registered for the offence under Sections 341, 323 and 504/34 of the Indian Penal Code and under Sections 25(1-b)A/26/27/35 of the Arms Act.

Allegation has been made that on account of land dispute the petitioner and co-accused assaulted the informant. It has also been alleged that co-accused Ram Jatan Yadav and this petitioner jointly fired upon the informant by country made pistol.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the

Patna High Court CR. MISC. No.45529 of 2019(2) dt.23-07-2019 2/2 prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
