Petitioner is accused in connection with Chanpatiya P.S. Case No. 356 of 2014 registered under Section 376 of the I.P.C. and section 6 of the Prevention of Children from Sexual Offence Act.

The allegation of informant is that her daughter Bagri Kumari had gone to attend the natural call in the morning on 18.12.2014. In the meantime, one Dhoda Dhangar informed to the informant about committing rape by this petitioner at her deaf and dumb daughter, Bagri Kumari aged about 12 years. Learned counsel appearing on behalf of the petitioner submits that, in fact, petitioner and informant are covillagers and petitioner has falsely been implicated in this case by the informant. It is submitted that while the victim was examined

Patna High Court Cr.Misc. No.22582 of 2015 (3) dt.01-10-2015 2/2 on the same day at 3.00 pm. but no any external injury was found on the person of the victim, daughter of the informant nor any sign of rape was found, as detailed in paragraph 29 of the case dairy. It is further submitted that petitioner, having no criminal antecedent, is in custody since 20.12.2014.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, West Champaran at Bettiah in connection with S.G.R. No. 67 of 2014 arising out of Chanpatiya P.S. Case No.356 of 2014.
