The petitioner apprehends his arrest in connection with Forbesganj (Simraha) P.S. Case No.404 of 2022 registered under Sections 379 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case with ulterior motive. Nothing has been recovered from his conscious possession or from his house. The petitioner has got no criminal antecedent. Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that petitioner and other accused persons are alleged to have stolen electric wire and the stolen electric wire was being carried on the motorcycle of the

Patna High Court CR. MISC. No.48885 of 2022(6) dt.08-05-2023 2/2 petitioner, which were seized by the police. Therefore, the petitioner does not deserve anticipatory bail. Having considered the above facts and circumstances of the case as well as the nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
