JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-06-2022 Heard learned counsel for the petitioners and learned APP for the State and also perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 420, 120B and 414 of the Indian Penal Code and Sections 30(a) of the Bihar Prohibition and Excise Act, 2018. It is a case of recovery of about 2157.120 liters of foreign made liquor as well as 477 rice packets from the three vehicles.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has no concern with the seized vehicles and rice and nothing has been recovered from the

Patna High Court CR. MISC. No.58526 of 2021(3) dt.22-06-2022 2/2 conscious or constructive possession of the petitioner and he has not been apprehended at the spot and the name of the petitioner came into light on the basis of confessional statement of apprehended co-accused Arun Kumar.

Learned APP appearing for the State on the basis of the case diary has opposed the prayer for anticipatory bail. Considering the aforesaid submissions, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Minapur P.S. Case No. 629 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
