In the present case, two prayers have been made, firstly with regard to vacating the order of suspension which has been rendered infructuous on account of the fact that during pendency of the writ application, the petitioner has superannuated from service and, secondly, a prayer has been made that the enquiry officer has submitted its report but, no final decision has been taken as yet by the authority.

In that view of the matter, let the authority concerned should decide the matter and take a decision in accordance with law within a period of three months from the date of receipt/production of a copy of this order.
