1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The learned counsel for the petitioner submits that petitioner had earlier moved this Court seeking anticipatory bail by filing Cr. Misc. No.38973 of 2026 and the same was dismissed for non-prosecution by an order dated 18.06.2026. It is next submitted that inadvertently, the instant anticipatory bail has been filed when a restoration application ought to have been filed for restoring Cr. Misc. No.38973 of 2026 to its original file.

3. The learned counsel for the petitioner thus seeks permission to withdraw the instant anticipatory bail application with liberty to the petitioner to file a restoration application

Patna High Court CR. MISC. No.50485 of 2026(2) dt.24-07-2026 2/2 seeking restoration of Cr. Misc. No.38973 of 2026.

4. Permission is accorded.

5. Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
