JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
As per the prosecution case, three unknown miscreants looted the E- rickshaw of the informant after sedating him.
Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused, Sonu Kumar and only material that has come against this petitioner is that the looted E- rickshaw has been recovered from the house of this
Patna High Court CR. MISC. No.58438 of 2021(3) dt.25-03-2022 2/2 petitioner. It is submitted that E- rickshaw has been recovered near the house of this petitioner which is an open place. Petitioner claims clean antecedent and is in custody since 04.08.2021and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that the looted E- rickshaw has been recovered from the house of this petitioner. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
