JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-01-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State and also heard the learned Special Public Prosecutor for the Vigilance. The petitioner apprehends his arrest in connection with Tekari P.S. Case No. 335 of 2020 registered for offence punishable under sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

As per allegation, the petitioner has become successful in securing the job of Panchayat Teacher after producing forged educational certificates.

The learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.50005 of 2022(3) dt.24-01-2023 2/2 on similar footing, co-accused Rashmi Kumari has been granted anticipatory bail, vide order dated 24.02.2022, in Cr. Misc. No. 27875 of 2021. He has submitted further that the petitioner has resigned from his services as per direction of this Court in C.W.J.C. No. 15459 of 2014.

On the other hand, the learned Special Public Prosecutor and the learned Additional Public Prosecutor have opposed the prayer for bail.

Considering the fact that the other co-accused persons have been granted anticipatory bail, let the petitioner abovenamed, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 335 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
