====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Shahpur P.S. Case No. 371 of 2020 instituted for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.06.2021, charge-sheet has been submitted and has antecedent of five cases.

Allegation is of looting the informant of Rs.19,500/- along with his Bolero vehicle and other documents as detailed in the FIR by unknown criminals on the point of pistol. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the case and the FIR

Patna High Court CR. MISC. No.59441 of 2021(2) dt.09-03-2022 2/2 was against unknown and was completely unaware that the vehicle in which he was travelling was a looted vehicle. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that in para 38 of the case diary it has come that Rohtas Police has arrested the petitioner along with other accused persons from a Bolero vehicle for which another case has been instituted and it was found that the said Bolero vehicle was the looted vehicle of the informant.

At this stage, learned counsel for the petitioner seeks permission to withdraw this application with liberty to renew his prayer for bail after framing of the charge.

Permission is accorded.

Accordingly, this application is dismissed as withdrawn in connection with the aforesaid case pending in the Court of learned Additional Chief Judicial Magistrate, Bhojpur at Ara.
