JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-05-2022 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Phulwariya P.S. Case No. 302 of 2021 dated 27.08.2021 instituted for the offences under Sections 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

120.96 litres of liquor has been said to be recovered from a vehicle which was being driven by the petitioner. The learned counsel for the petitioner has submitted that the petitioner had no idea that liquor had been loaded in the vehicle.

However looking at the period of the custody which is

Patna High Court CR. MISC. No.57424 of 2021(2) dt.23-05-2022 2/2 from 28.08.2021 and the petitioner having clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned IInd Additional Sessions Judge cum Special Judge (Excise), Gopalganj in connection with Phulwariya P.S. Case No. 302 of 2021.
