Petitioner seeks bail in a case registered under section 302 of the Indian Penal Code.

Petitioner is named in the first information report but the informant claimed that he learnt the name of the petitioner on the basis of confidential information.

Moreover, it is admitted case of the prosecution that more than hundred persons assaulted the deceased under the impression that deceased was a thief.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Mrs. Shema Eram, Judicial Magistrate, Ist Class, Patna in Phulwarisharif P.S.
