The petitioner seeks pre-arrest bail in connection with Hajipur Town P.S.Case No.473 of 2017 registered under Sections 147, 149, 341, 323, 307, 427, 353, 186 and 504 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that in the entire FIR there is no allegation of any overt act, use of force and vandalism against the petitioner. The only allegation against him is of sitting on the road who after persuasion by the police went away. He submitted that, as a matter of fact, the petitioner was working on contractual basis as I.T. Assistant with
Patna High Court Cr.Misc. No.61187 of 2017 (2) dt.22-12-2017 2/2 Finance Department, Government of Bihar. He submitted that the petitioner has got no criminal antecedent and having got roots in the society is not likely to abscond or tamer with the evidence. Learned counsel for the State opposed the prayer for grant of pre-arrest bail to the petitioner.
Regard being had to the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S.Case No.473 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
