The petitioner is languishing in custody in a case registered for the offences punishable under Sections 363, 366A of the Indian Penal Code and Section 8 of the POCSO Act.

It is a case of kidnapping of the minor daughter of the informant for marriage purposes.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 06.09.2022, the F.I.R was registered on 14.09.2022

Patna High Court CR. MISC. No.49145 of 2023(2) dt.11-08-2023 2/2 without explaining the delay. The victim in her 164 Cr.P.C statement has stated that she of her own goodwill, went with the petitioner and performed marriage. The petitioner is languishing in custody since 15.06.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, POCSO Act, East Champaran at Motihari in connection with Patahi P.S. Case No. 194 of 2022.
