The petitioner seeks pre-arrest bail in connection with Purnea Sadar P.S.Case No.139 of 2017 registered under Sections 420 and 408 of the Indian Penal Code and Section 7 of the Essential Commodities Act.
It is submitted by the learned counsel for the petitioner that save and except that the petitioner happens to be Munshi of co-accused Dinesh Jaiswal, there is no other material to connect him with the offence. He submitted that even on merits no case would be made out against the petitioner as no food grain was recovered from the godown of Dinesh Jaiswal rather recovery was made from the trailer attached to the tractor which was standing in
Patna High Court Cr.Misc. No.61154 of 2017 (2) dt.22-12-2017 2/2 front of the godown of co-accused Dinesh Jaiswal. He further contended that co-accused Dinesh Jaiswal has already been granted pre-arrest bail vide order dated 09.11.2017 passed in Cr.Misc. No.51747 of 2017 by a Bench of this Court. In view of the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Purnea Sadar P.S.Case No.139 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
