The main grievance of the petitioner is that though the offence under section 307 of the Indian Penal Code is made out against the accused persons but cognizance has not been taken under the aforesaid section of the Indian Penal Code. 3.

This application is disposed of with liberty to the petitioner to raise the aforesaid ground at the stage of framing of charge.
