JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, he was arrested and confessed his guilt leading to recovery of stolen articles from possession of coaccused, Gautam Kumar. Contention on behalf of the petitioner is that petitioner does not have any criminal antecedent and as a matter of fact, he has been implicated in this case on account of village politics. It is further contended that petitioner is in jail custody

Patna High Court Cr.Misc. No.14428 of 2016 (2) dt.07-04-2016 2/2 since 04.02.2016 and having more or less similar allegation, one co-accused, Robin Kumar has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, keeping in mind that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Barh in connection with Athmalgola P.S.
