In the present writ application, the following reliefs have been sought for on behalf of the petitioner : 1(i) For quashing of letter no.1027 dated 6.4.2016, contained in ANN-4, issued by the District Program Officer (Establishment), Nawada (for shortDPO/Est.) directing the BDO-cum-Secretary, Block Teachers Selection Unit, Nardiganj to cancel the appointment of petitioner as Block Teacher, Upgraded Middle School, Bhelu Bigha, Anchal Nardiganj, under the provisions of Primary Teachers
Patna High Court CWJC No.12395 of 2018(2) dt.16-08-2018 2/3 Selection Rules, 2012 (for short Rule-2012), to register F.I.R. and to ensure recovery of amount taken as honorarium, on the basis of an Enquiry Report (dated 19.6.2015) wherein Experience Certificate of 6 Lok Shikhsak including petitioner were allegedly verified and Experience Certificate of petitioner was not found issued on letter/Sl. No.1894 in ISSUING REGISTER.
(ii) Further for quashing of consequential letter no.667 dated 4.5.2016, contained in ANN-5, whereby the respondent-BDO, referring the direction of respondent-DPO/Est. Dated 6.4.2016, cancelled the appointment of petitioner and ordered to deposit the amount taken as honorarium in Block Office and forwarded it's copy to SHO, Nardiganj P.S. for registering F.I.R. which appears to have been posted under registered letter on 20.7.2016 for communication to petitioner, all without any notice or without affording any opportunity of hearing to petitioner at any stage by anyone to explain his innocence/fault/genuineness of said Experience Certificate.
Considering the reliefs sought for in the present writ application, the petitioner is directed to file a representation before the Respondent No.3 i.e. The District Education Officer, Nawada regarding the redressal of his grievance. The Respondent No.3 shall consider and dispose of the
Patna High Court CWJC No.12395 of 2018(2) dt.16-08-2018 3/3 representation and pass an appropriate order in accordance with law within a period of one month from the date of filing of such representation.
With the aforesaid observation and direction, the present writ application stands disposed of.
