The petitioner is languishing in custody since 22.02.2016 in connection with Naubatpur P.S. Case No. 365 of 2014 for the offences instituted under Sections 341, 452, 323, 324, 326, 307/34 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that the petitioner and other co-accused persons entered into the house of the informant and caused injuries to the wife of the informant, sons and daughter-in-law of the informant by sharp edged weapons, Accused persons also made firing to terrorize them. When the villagers assembled at the place of occurrence, accused persons fled away from their motorcycles.
Patna High Court Cr.Misc. No.16968 of 2016 (3) dt.23-05-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 22.02.2016 and the charge sheet has been submitted in the case. There is general and omnibus allegation has been made against the petitioner. There is no specific injury attributed against the petitioner. The present case has been instituted because the petitioner had instituted a case against the informant and others for the offences under Sections 498(A) and 364/34 of the IPC. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Danapur, Patna, in connection with Naubatpur P.S. Case No. 365/2014. U.K./- (Sudhir Singh, J) U T
