JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-11-2022 The limited prayer of the petitioner is to direct the Circle Officer, Mainatand Anchal, District - West Champaran i.e. the respondent no. 5 to conclude the proceedings of the Encroachment Case No. 8 of 2019-20.

The learned counsel for the respondent State submits that in case the aforesaid encroachment case has not been taken

Patna High Court CWJC No.17358 of 2021(2) dt.02-11-2022 2/2 to its logical conclusion, the same shall be concluded by passing appropriate orders under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, within a fixed time frame. Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the respondent no. 5 to conclude the proceedings of the aforesaid Encroachment Case by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of 12 weeks of receipt/production of a copy of this order.

Accordingly, the present writ petition stands disposed off on the aforesaid terms.
