JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 01-08-2025 Heard Mr. Alok Kumar Alok, learned counsel for the petitioner and Mrs. Sangeeta Sharma, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Nayagaon P.S. Case No. 173 of 2023 instituted for the offence under Sections 149, 323, 341, 392, 406, 420, 467, 468, 471, 504 and 506 of the I.P.C. and Section 27 of the Arms Act.
3. The case of the prosecution in short is that a sale deed was executed by Karmu Rai in favour of complainant and the consideration amount was Rs. 9,63,000/-. Petitioner is the witness on that sale deed.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has no

It has also been submitted that it is further case of the complainant that the accused persons assaulted and pointed gun. One accused pointed knife. It has also been submitted that similarly situated accused Raushan Kumar against whom allegation is that he has pointed knife has been granted anticipatory bail by learned Co-ordinate Bench vide order dated 10.07.2025 in Cr. Misc. No. 43005 of 2025. The case of this petitioner stands on similar footing. He has no criminal antecedent.
5. Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Nayagaon P.S. Case No. 173 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chapra, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
