The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code.

Allegation is that 20-25 unknown miscreants armed with pistol, dab, knife, lathi and danda came and assaulted the brother of the informant and looted Rs.5 lacs, ornaments worth Rs.15 lacs, mobile phone etc. from his house. It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.4.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional

Patna High Court CR. MISC. No.44858 of 2019(2) dt.22-07-2019 2/2 statement of co-accused. Petitioner has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Chakia P.S. case No.61 of 2019.
