JUSTICE SUDHIR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 399, 402, 414/34 of the Indian Penal Code and 25(1-b)A, 26 (ii) and 35 of Arms Act.

The prosecution story, in brief, is that on 05.02.2016 while the informant, O/C of Supaul Police Station, was on patrolling duty he received information that some criminals assembled in I.T.I. Hostel after committed crime, reached at the place of occurrence and found that nine persons were taking liquor and chicken. On seeing the police party, culprits started jumping from the roof of the Hostel but the police arrested five persons including the petitioner and on search country made pistols were recovered from co-accused Nandan Kumar and Rajiv Kumar,

Patna High Court Cr.Misc. No.17106 of 2016 (3) dt.24-05-2016 2/2 black purse and health insurance card of Sanjay Yadav has been recovered from co-accused Santosh Kumar and one Micromax mobile has been recovered from the possession of the petitioner. It is submitted on behalf of the petitioner that the petitioner is in custody since 06.02.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no recovery of any arm from the possession of the petitioner. One mobile is said to have been recovered from the possession of the petitioner. So far fire arms are concerned, they are said to have been recovered from the possession of other accused persons, namely, Nandan Kumar and Rajiv Kumar. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Supaul P.S.Case No. 62 of 2016.
