The petitioner apprehends his arrest in Habibpur P.S. Case No.18 of 2017 registered under Sections 323, 327, 384, 420, 406, 354, 120B of the Indian Penal Code.
The learned counsel for the petitioner submits that the informant filed complaint petition on the basis of which present FIR was lodged. The informant alleged in her complaint petition that she obtained a piece of land vide sale deed dt.5.5.2010 from the petitioner and erected boundary all around her land but when she visited her land, she found that boundary was demolished. The learned counsel for the petitioner further submits that the petitioner sold land to the complaint-informant but now informant wanted to get some more land, that is why, false case
Patna High Court Cr.Misc. No.63561 of 2017 (2) dt.11-01-2018 2/2 has been lodged.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XII, Bhagalpur in connection with Habibpur P.S. Case No.18 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
