Mr. Alok Anand, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 15-10-2025 Heard learned counsel for the petitioner, learned counsel for the Informant and learned APP for the State and perused the case diary.

2. The petitioner is in custody in a case registered for the offence punishable under Sections 126(2), 352, 109, 3(5) of the BNS and Section 27 of the Arms Act and later on Section 103(1) of the BNS and Section 25(1-b) a 26/35 of the Arms Act added.

3. As per allegation in the FIR, the petitioner acted as liner upon which, co-accused persons made gun shot injury upon the victim.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next

No.52412 of 2025(3) dt.15-10-2025 2/2 submits that there is no recovery of any arms from the possession of the petitioner and similarly situated co-accused person has already been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 53844 of 2025 and petitioner is in custody since 19.03.2025 and he has got clean antecedent as stated in para-3 of the petition. Petitioner is not named in the FIR nor he has been arrested at the spot.

5. Learned APP for the State as well as the Informant opposes the prayer for bail of the petitioner.

6. In view of the aforesaid facts and circumstances as well as the fact that similarly situated co-accused has already been granted bail by a Co-ordinate Bench of this Court, so let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Saharsa Sadar P.S.
