16-06-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in G.R.P. Patna P.S. Case No. 456 of 2018, registered for the offence under Sections 302, 201/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased. There is allegation of causing death of deceased and throwing her dead-body on the railway track.

It is submitted on behalf of petitioner that much before the occurrence, the deceased was residing in her parental house and petitioner has already filed a complaint case, vide Complaint Case No. 1121 of 2018, which is pending in the court of learned Judicial Magistrate 1st Class, Patna (Annexure - II) as well as petitioner has filed a divorce case, vide Divorce Case

Patna High Court CR. MISC. No.4157 of 2021(3) dt.16-06-2021 2/2 No. 1251 of 2018, which is also pending in the court of learned Principal Judge, Family Court, Patna (Annexure - III). It is further submitted that deceased had died due to accidental death, for which, a U.D. Case No. 61 of 2018 was registered, but after one & half day, the present case has been lodged. Petitioner is in custody since 16.09.2020. Chargesheet has already been submitted.

However, learned A.P.P. for the State has vehemently opposed the bail application.

Considering the aforesaid facts & circumstances and the fact that petitioner is husband of the deceased and there is specific allegation of causing death and throwing the dead-body on the railway track, the bail petition of petitioner is rejected. (Prabhat Kumar Singh, J.) anay U T
