JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant and other police officials raided Bardah Diara and unearthed illegal mini gun factory and also seized some firearms. Petitioner and others were caught there and one country made loaded pistol is said to have been recovered from conscious possession of the petitioner.

Learned counsel for the petitioner submits that petitioner was caught on mere suspicion and, as a matter of fact, nothing has been recovered from conscious possession of the petitioenr. It is also pointed out by him that co-accused Md. Fazle has already been granted privilege of bail by this Court. Considering the aforesaid facts and circumstances as

No.14535 of 2016 (2) dt.08-04-2016 2/2 well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil P.S.Case No. 193 of 2015.
