JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302, 201, 120B/34 of the Indian Penal Code.
This petitioner and other accused persons are alleged to have killed the son of the informant and threw the dead body on the railways track due to some monetary dispute. Learned counsel for the petitioner submits that after investigation police submitted charge sheet under section 306 Indian Penal Code. He further submits that son of the informant was railway employee and he might have met with an accident while checking the railways track and even as per the suicide note, alleged to have been recovered from the victim's possession, thrust of accusation is against co-accused Pramod
Patna High Court CR. MISC. No.58246 of 2021(2) dt.04-02-2022 2/2 Paswan. Petitioner is merely said to be the person to whom money was given by the victim on interest. Petitioner claims clean antecedent and he is in custody since 1.7.2021. Similarly situated co-accused have already been allowed bail by this Court vide orders passed in Cr.Misc.No. 35284/2021 and 34168/2021.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas at Sasaram in Shivsagar Police Station Case No. 186 of 2020.
