JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302 and other allied Sections of the Indian Penal Code. Petitioner happens to be F.I.R. named accused, but according to the prosecution case itself, the assailants are other accused and petitioner was only a member of unlawful assembly without having any specific overt act.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class,
