The petitioner seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act. Allegation is that one country made pistol along with one live cartridge is recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.1.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. One country made pistol along with one live cartridge is said to have been recovered.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 11th Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. case No.3 of 2019.
