2. The petitioners apprehend arrest in connection with Purnahiya PS Case No.43 of 2024 dated 10.05.2024, instituted under Sections 363, 366-A/34 of the Indian Penal Code.

3. The prosecution case, in brief, is that Ravi Kumar son of the petitioners have kidnapped the minor daughter of the informant for the purpose of marriage in connivance with other accused persons.

4. Learned counsel for the petitioners submits that the main allegation is against Ravi Kumar, who is also juvenile as per school record and the victim is also minor as per the report of Anganbari Sevika. The petitioners are the parents of Ravi

Patna High Court CR. MISC. No.54144 of 2024(3) dt.06-09-2024 2/2 Kumar. Learned counsel further submits that the statement of the victim has been recorded under Section 164 Cr. P. C. in which she has not whispered a word against the petitioners. Further submission is that one of the co-accused, Shashi Kumar Singh, who happens to be the uncle of the main accused, has been granted anticipatory bail by this Court vide order dated 21.08.2024 passed in Cr. Misc. No.50716 of 2024. Lastly, it is submitted that the petitioner has clean antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sheohar, in Purnahiya PS Case No.43 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

7. The application stands allowed.
