This application for anticipatory bail arises out of Supaul Nadi P.S. Case No. 08 of 2019, disclosing offences under Sections 341, 323, 498A, 304B and 201/34 of the Indian Penal Code, including Section 3⁄4 of the Dowry Prohibition Act. Petitioner no.1 is father-in-law and petitioner no.2 is mother-in-law. Petitioner n.3 is the younger brother of the husband of the deceased.

My attention has been drawn to he FIR by learned counsel for the petitioners to contend that there is no specific allegation against these petitioners of having made any demand

Patna High Court CR. MISC. No.45345 of 2019(2) dt.23-07-2019 2/2 of dowry. He contends that these petitioners have been implicated only because they are related to the husband of the deceased.

Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned CJM, Supaul in connection with Supaul Nadi P.S. Case No. 08 of 2019, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
