The petitioner is in custody in a case registered under Sections 376 of the Indian Penal Code.
The prosecution case in, brief, is that the daughter of the informant is raped by the petitioner when he was out of his house and she was contiguously raped and conceived the pregnancy, then the petitioner refused to marry with her when he was pressurized to marry.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It is further submitted that the victim had love affairs with the
Patna High Court Cr.Misc. No.23988 of 2015 (2) dt.06-07-2015 2/2 petitioner but the petitioner had no intention to establish the physical relation with the victim. It is further submitted that the petitioner has got no criminal antecedent. From the FIR it is evident that for last two and a half months the victim never whisper about the said incident. The petitioner is in custody since 05.03.2015.
On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.P.Singh, Special Judge, Katihar in Dandkhora P.S.Case No. 13/2015, (G.R.No. 519/2015). (Sudhir Singh, J) singh/- T
