The petitioner is languishing in custody since 18.06.2015 in a case registered for the offences punishable under Sections 15, 18 and 20 of the NDPS Act.

The prosecution case is that the informant being the Sub-Inspector of Police raided a Dhaba namely Patialia of the co-accused Jeet Singh and recovered 90 kgs. of Poppy Straw. Two persons were found sitting in a Swift Desire car, on they being apprehended they disclosed their name as petitioner Tarsen Singh and co-accused Manjot Singh. From the car two bags were recovered each containing 24 kgs. of Poppy Straw. It is submitted by learned senior counsel for

No.16993 of 2016 (2) dt.19-05-2016 2/2 the petitioner that the petitioner being a passenger was travelling in the car and he was not aware of the Poppy Straw being kept in the car in question. The car has been found registered in the name of Rajendra Nath Patra. It is further submitted that the total weight of the recovered contraband from the car was found weighing 48 kgs. which is between the small and commercial quantity. Similarly situated co-accused Manjot Singh has been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 45579 of 2015.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gaya connection with Barachatti P.S. Case No. 241 of 2015/NDPS Case No. 19 of 2015.
