The petitioner seeks bail in a case instituted for the offences under Sections 394 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier this Court vide order dated 4.3.2015 passed in Cr. Misc. No.5485 of 2015 rejected the prayer for bail of the petitioner.
Altogether five witnesses have been examined. The person who identified the petitioner in TIP, namely, Birendra Kumar Yadav (P.W.6) has turned hostile. The petitioner is in jail since 31.10.2014.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.23721 of 2015 (6) dt.30-03-2016 case, let petitioner, Lalo alias Lalu Yadav, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Purnea, in connection with K. Nagar P.S. Case No.562 of 2014, subject to the condition that petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
The trial court is directed to conclude the trial within a period of four months from the date of receipt/production of a copy of this order.
