The petitioner seeks bail in a case under Sections 307 and 34 of the Indian Penal Code.

The petitioner and a co-villager of the informant hired the vehicle of the informant but both the accused persons assaulted the informant with knife. The informant got five injuries. It is submitted that four injuries are simple in nature and one injury found on the neck is opined to be endangering to life caused by sharp-edged weapon and grievous in nature. It is submitted that two persons are alleged to have assaulted the informant with knife but the informant did not disclose as to who was the author of the injury on the neck of the informant which was opined to be grievous in nature. The petitioner is in jail since 21.01.2015. The petitioner has already remained in jail for more than eight months.

Patna High Court Cr.Misc. No.23708 of 2015 (3) dt.24-09-2015 2/2 Learned A.P.P., however, vehemently opposed the prayer for bail.

It appears that of course the petitioner is alleged to have assaulted the informant with knife along with other accused person, but out of the five injuries, four injuries are found to be simple in nature and the petitioner has already remained in jail for more than eight months.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Raghuvansh Narayan, Judicial Magistrate, 1st Class, Lakhisarai in Medani Chowki P.S. Case No. 83 of 2014.
