2. Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 18.05.2022 in Cr. Misc. No. 7801 of 2022.

3. Trial Court report reveals that charge has already been framed on 29.07.2022 and till date not a single prosecution witness has been examined.

4. Learned counsel for the petitioner submits that petitioner is in custody since 19.07.2018 .

5 . Considering the fact period of custody and tardy progress of trial, petitioner, above named, is directed to be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the

Patna High Court CR. MISC. No.52976 of 2023(3) dt.13-10-2023 2/2 satisfaction of the Addl. District and Sessions Judge III, Civil court, Danapur in connection with Sessions Trial No. 407 of 2020 arising out of Naubatpur P . S. Case No. 274 of 2017, with subject to following conditions:

(a) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason , his bail bonds shall be cancelled by the court below .

(b) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
