JUSTICE SUDHIR SINGH ORAL ORDER 19-12-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending thier arrest in a case instituted under Sections 498(A), 304(B), 201/34 of the Indian Penal Code.
The allegation against the petitioners is of committing murder of the deceased due to non-fulfillment of the demand of dowry.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in-laws of the deceased. They are
Patna High Court Cr.Misc. No.61949 of 2017 (2) dt.19-12-2017 2/2 separate in mess and property from the husband of the deceased. The petitioners have been made accused due to mistake of fact. The matter has already been compromised between the parties, vide Annexure-2 to the present application.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Sheohar P.S. Case No.177/2016 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheohar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
