The petitioner seeks bail in connection with Pakari Barawan P.S. Case No.39 of 2012 registered under Sections 406, 409, 467, 468, 471, 420 and 120-B of the Indian Penal Code.
The allegation of the informant is that she opened the Fixed Deposit Account in the name of her four sons of Rs.1,00,000/- each in the State Bank of India, Pakari Barawan Branch, with the help of the petitioner and the Accountant of Bank, namely, Manoj Kumar Chaudhary. When the informant approached the Bank to take the loan on the Fixed Deposit Amount, then she was informed by the Manager of the Bank, the amount is not in her account. Thereafter, when the informant showed her pass-book, the Manager of the Bank asked her to

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner had only accompanied the informant to the Bank at the time of opening the Fixed Deposit Account in the name of her four sons. Moreover, Manoj Kumar Chaudhary alias Manoj Chaudhary, the Accountant of the Bank, has already been granted bail by a Bench of this Court vide order dated 05.03.2014 passed in Criminal Misc. No.28076 of 2013 on the submission that the amount of Rs.4,00,000/- alleged to have been taken out from the account of the informant has already been paid to the son of the informant, Rambandan Chauhan. The petitioner is in custody since 07.04.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Nawada, in connection with Pakaribarawan P.S.
