Petitioner apprehends his arrest in Complaint Case No.76 C 2/2019 for the offence allegedly committed by the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that small quantity of liquor was recovered from behind the house of the petitioner. The petitioner has got no criminal antecedent but it appears that eight bottles of whiskey were recovered from back portion of the house of the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
